In submitting a proposal, the author must acknowledge that in case part or all of his proposal are included in DAVIC specifications and the included part contain patented items which are necessary for the implementation of DAVIC specifications, the proposer will accept the IEC/ISO/ITU practice for patented items in international standards.
This amounts to either giving free use of the patented items, or giving license on fair and reasonable terms and on a non-discriminatory basis.
This acknowledgement must be made on official company letterhead and signed by the appropriate company officer.
Companies are advised that DAVIC reserves the right to disqualify submission that lack a properly excuted Intellectual Property Rights Statement.
When a technology whose use is covered by a piece of IPR is incorporated in a DAVIC specification, an IPR statement is secured from the owner of the IPR.
The DAVIC Secretariat keeps a copy of all IPR statements.
DAVIC cannot guarantee that a technology for which an IPR statement has been obtained does indeed require that IPR for its implementation.
In spite of its best efforts, DAVIC cannot guarantee that a technology incoprorated in a DAVIC specification does not require the use of a piece of IPR, even though a statement has not been secured.
